Agreement to Terms
By engaging Kodiak Fence Company for fence installation, repair, staining, or related services, you agree to these Terms of Service. These terms constitute a legally binding agreement between you ("Customer") and Kodiak Fence Company ("Company," "we," "us," or "our").
Our services are available to property owners and authorized representatives in the Dallas-Fort Worth metropolitan area, including Flower Mound, Plano, Frisco, Irving, and surrounding cities.
Services Provided
Kodiak Fence Company provides:
- Residential and commercial fence installation
- Fence repair and replacement
- Fence staining and maintenance
- Automatic gate installation and repair
- Custom fence design and construction
- Free on-site estimates
All services are subject to availability, site conditions, and local regulations. We reserve the right to decline projects that fall outside our service area or expertise.
Estimates and Pricing
- Free Estimates: We provide free, no-obligation estimates for all projects. Estimates are valid for 30 days from the date issued.
- Written Quotes: All project pricing is provided in writing before work begins. The quote includes materials, labor, and any applicable permits.
- Price Changes: If site conditions differ from the initial assessment (hidden obstacles, grade changes, utility conflicts), we will notify you of any price adjustments before proceeding.
- Additional Work: Any work beyond the original scope requires written approval and may incur additional charges.
Payment Terms
- Deposit: A deposit may be required to secure your project date and order materials. Deposit amounts vary by project size.
- Final Payment: Balance is due upon completion of the project, unless otherwise agreed in writing.
- Payment Methods: We accept cash, check, credit cards, and financing options for qualified customers.
- Late Payments: Accounts past due may be subject to collection fees and interest charges as permitted by Texas law.
Customer Responsibilities
To ensure successful project completion, customers agree to:
- Provide accurate property boundaries and survey information
- Obtain necessary HOA approvals before work begins
- Call 811 to mark underground utilities at least 48 hours before scheduled work
- Ensure clear access to the work area
- Remove personal property, landscaping, or obstacles from the fence line
- Secure pets during installation
- Communicate with neighbors about shared fence projects
Permits and Regulations
Kodiak Fence Company will obtain necessary permits for fence installation when required by local municipalities. Permit fees are included in the project quote unless otherwise noted.
Customers are responsible for ensuring their fence project complies with HOA guidelines and deed restrictions. We recommend obtaining HOA approval in writing before scheduling installation.
Warranty
Kodiak Fence Company provides a 5-year workmanship warranty on all fence installations. This warranty covers defects in installation and labor. Material warranties are provided by the manufacturer and vary by product.

Limitation of Liability
Kodiak Fence Company's liability is limited to the contract value of the project. We are not liable for:
- Damage to unmarked underground utilities
- Pre-existing property conditions
- Acts of nature, vandalism, or third-party damage
- Consequential or incidental damages
- Delays caused by weather, material shortages, or circumstances beyond our control
Cancellation Policy
- Cancellations made more than 7 days before scheduled work: Full deposit refund
- Cancellations made within 7 days: Deposit may be retained to cover material orders and scheduling costs
- Cancellations after materials are ordered: Customer is responsible for non-refundable material costs
Dispute Resolution
Any disputes arising from these terms or our services will be resolved through good-faith negotiation. If negotiation fails, disputes will be settled through binding arbitration in Denton County, Texas, in accordance with Texas law.
Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the new terms.
